About Electoral Commissioner’s Office
The EMB is composed of three units that are established under sections 38 and 40 of the Constitution. These are the Electoral Supervisory Commission (ESC); the Electoral Boundaries Commission (EBC); and the Electoral Commissioner (EC). The EBC consists of a chairperson and between two and seven other members. The Commissioners are appointed by the President after consultation with the Prime Minister, Leader of the Opposition and leaders of other parties in the Assembly.
The ESC has the same number of members who are also appointed in the same manner as members of the EBC. In practice the personnel for the two bodies is the same. Members of both the EBC and ESC are appointed for a five-year term. The law does not expressly guarantee the independence of these two bodies, but in practice, they have enjoyed independence and command respect from all stakeholders.
The EC is appointed by the Judicial and Legal Service Commission and is a public officer. The Constitution however provides that the EC shall not be subject to the direction and control of any person or authority in the exercise of his powers and functions. The Electoral Commissioner is assisted in his task by a Chief Electoral Officer, a Deputy Chief Electoral Officer, two Principal Electoral Officers, two Senior Electoral Officers, ten Electoral Officers and other junior staff.
